Mohali, June 17

A 26-year-old MBA professional living in SAS Nagar (Mohali) approached the Mohali Police, alleging that her parents and maternal relatives were trying to force her into marriage against her wishes.

When the police didn’t act on her complaint, she moved the Punjab and Haryana High Court repeating the allegations.

The woman, who is employed and was pursuing further studies independently, said she had faced sustained pressure from her family to marry a man of their choosing ever since she began earning.

She alleged that around two months earlier, she was called to a location in Mohali under false pretences and forcibly taken to her parental home, where she says she was subjected to physical assault, intimidation and threats between April and June aimed at compelling her to accept a match her relatives had arranged with a man working as a driver in Baddi, Himachal Pradesh.

Mohali MBA Woman complaint

In a written complaint to the Senior Superintendent of Police, SAS Nagar, on June 10, she alleged her relatives had warned that refusing the marriage would cost her her life, and that they would dispose of her body so no evidence remained. She also claimed her maternal uncles had paid the prospective groom roughly Rs 7 lakh to secure the alliance.

None of these allegations have been independently verified, and her family has not yet had an opportunity to respond before any court.

Mohali MBA Woman then moved HC: A day after filing the police complaint, she moved the High Court seeking a direction to SAS Nagar police to protect her life and liberty from her named relatives.

‘No person can be compelled to marry’

Hearing the plea, Justice Deepak Gupta held that personal autonomy — including the right to decide whether, when and with whom to marry — falls within the fundamental right to life and liberty guaranteed under Article 21. “No person can be compelled to enter into a matrimonial alliance against his or her wishes,” the order states.

The court, however, was explicit that it was not ruling on the truth of allegations of Mohali MBA Woman against her family, nor commenting on the underlying dispute between them. The actual relief granted was procedural: Justice Gupta directed the SSP, SAS Nagar — or an officer authorised by him — to examine her June 10 complaint, assess whether a genuine threat exists, and take protective measures “forthwith” if one is found.
